Uniform act on arbitration law

This uniform act is the general arbitration law of OHADA member states, including Gabon, for any arbitration seated in one of them. It replaced the act of 11 March 1999 and has applied since 15 March 2018. It recognises the validity of arbitration agreements, including arbitration based on an investment treaty, and governs the constitution of the arbitral tribunal, the independence of arbitrators, the conduct of proceedings, the award and available remedies, in particular the action for annulment. It also sets the conditions for recognising and enforcing awards. For investors, it offers a way to settle commercial disputes outside state courts, alongside the institutional arbitration offered by the Common Court of Justice and Arbitration (CCJA).
