Uniform act on simplified debt recovery procedures and enforcement measures

This text, often called AUPSRVE, organises debt recovery and enforcement in OHADA member states. Its first version was adopted in Libreville on 10 April 1998. The revised version, adopted in Kinshasa on 17 October 2023, came into force on 16 February 2024. It provides two simplified court procedures: the payment order, for debts that are certain, quantified and due, and the order to deliver or return movable property. It then governs protective attachments, which freeze assets or funds pending judgment, and enforcement attachments, for example on bank accounts, wages, movable goods or real estate. It also sets out the role of bailiffs and the enforcement judge. It is a practical tool for suppliers and lenders seeking to recover a debt in Gabon.
