Law regulating electronic transactions

This law, adopted on the basis of article 47 of the Constitution and carried by the ministry in charge of the digital economy, sets the legal framework for electronic transactions in Gabon. According to UNESCO's policy monitoring platform, it covers information society services, non-commercial activities conducted remotely by electronic means concerning goods, services, rights or obligations, commercial, industrial, craft or professional activities carried out electronically by non-professionals, the digitisation of administrative and judicial procedures and formalities, and the publication of public information by the state, local authorities and bodies in charge of a public service. It is one of the first texts specific to Gabon's digital economy, alongside the 2023 cybersecurity law and the texts on personal data protection. The transition national development plan 2024-2026 provides for drafting its implementing texts and a digital code, which indicates that full implementation is still pending. For businesses in e-commerce, payment services or digital platforms, it is the starting point of any legal analysis, to be read together with the community regulation on payment services.
